IfLandlordappliesanyportionofthesecuritydepositforthepurposesaboveortoanyobligationofTenantatanytimeduringthetermofthisLease,Tenantmust,uponten(10)dayswrittennotice,reinstatethesecuritydeposittoitsfulloriginalamount.

Withinthree(3)weeksafterTenanthasvacatedthePremises,LandlordshallfurnishTenant,bypersonaldeliveryorbyfirst-classmail,postageprepaid,acopyofanitemizedstatementindicatingthebasisfor,andthedollaramountof,anyofthesecuritydepositretainedbyLandlord,alongwithacheckforanydepositbalance.TenantshallnotbedeemedtohavevacatedthePremisesforthepurposeofthisparagraphuntil(a)TenantreturnstoLandlordallkeystothePremises,and(b)TenanthassurrenderedthePremisestoLandlordfreeandemptyofallpersonsclaiminganyrighttopossessthePremises.

LandlordisnotobligatedtoreturnthesecuritydeposittotheTenantorgivetheTenantawrittendescriptionofdamagesandchargesuntiltheTenantgivestheLandlordawrittenstatementoftheTenant"sforwardingaddressforthepurposeofrefundingthesecuritydeposit.

IfLandlordsellsorassignsthePremises,LandlordshallhavetherighttotransferTenant"ssecuritydeposittothenewownerorassigneetoholdunderthisLeaseanduponsodoingLandlordshallbereleasedfromallliabilitytoTenantforreturnofsaidsecuritydeposit.

5.RentandLateCharge

Tenantagreesthatifthemonthlyrentisnotpaidinfullwithinthree(3)daysaftertheDueDate,TenantshallpayalatechargeofTWENTYDOLLARS($20.00)toLandlord,plusFIVEDOLLARS($5.00)foreachadditionaldatethattherentremainsunpaidaftertheDueDate.ThetotallatechargeforanyonemonthshallnotexceedONEHUNDREDANDSEVENTYDOLLARS($170.00).LandlorddoesnotwaivetherighttoinsistonpaymentoftherentinfullbytheDueDate.

6.Payment

7.Utilities
