第2条eprovisionsmedinesiseimplementregulations关于商品商标的规定应适用于服务商标.

wherethevariouscertificates,certifyingdocumentsandproofssubmittedunderthetrademarklawandtheseregulationsareinaforeignlanguage,thechinesetranslationthereofshallbeattached;wherethechinesetranslationisnotattached,thecertificates,certifyingdocumentsandproofsshallbedeemednottohavebeensubmitted.

article9inanyoneofthefollowingcircumstances,anystaffmemberofthetrademarkofficeandthetrademarkreviewandadjudicationboardshallwithdraw,orapartyorinterestedpart}mayrequesthimtowithdraw:

(l)heisapartyoracloserelativetoapartyoragent;

(2)heisrelatedinsuchawaywithapartyoragentinsofarastherelationwouldaffectimpartiality;or

(3)hehasinterestsinanapplicationfortrademarkregistrationoran}'othertrademarkmatters.

articlel0unlessotherwiseprovidedforintheseregulations,whereanydocumentissenttothetrademarkofficeorthetrademarkreviewandadjudicationboard,thedateofreceiptshallbethedateofdeliverywhereitisdeliveredpersonally}.orthedateofpostingindicatedbythepostmarkifitissentbypost;wherethedateofpostingindicatedbythepostmarkisillegible,orthereisnopostmark,thedateofreceiptshallbethedateonwhichthetrademarkofficeorthetrademarkreviewandadjudicationboardactuallyreceivesthedocument,exceptthattheinterestedpart]'isabletopresentevidenceastotheactualdateofpostingindicatedbythepostmark.

article11anydocumentofthetrademarkofficeorthetrademarkreviewandadjudicationboardmaybeservedbypost,bypersonaldeliveryorbyothermeans.whereaninterestedpartyentrustsatrademarkagency,deliveryofthedocumenttothetrademarkagencyshallbedeemeddeliverythereoftotheinterestedparty.

whereanydocumentissenttoaninterestedpartybythetrademarkofficeorthetrademarkreviewandadjudicationboard.thedateofreceiptshallbethedateofreceiptindicatedb]-thepostmarkonwhichtheinterestedpartyreceivesitifitissentbypost;wherethedateofpostingindicatedbythepostmarkisi1legible,orwherethereisnopostmark.thedocumentshal1bedeemedtohavebeendeliveredtotheinterestedpartyonthefifteenthdayfromthedateofpostingthedocument;thedateofreceiptshallbethedateofdeliveryifitisdeliveredpersonally.whereanydocumentcannotbesentbypostorbypersonaldelivery,thedocumentmaybeservedb}'makinganannouncement.attheexpirationofthethirtiethdayfromthedateoftheannouncement,thedocumentshallbedeemedtohavebeenserved.

article12whereanapplicationisfiledforinternationalregistration,itshallbedoneinaccordancewiththerelevantinternationaltreatiestowhichchinahasacceded.thespecificmeasuresshallbeprescribedbytheadministrativedepartmentforindustryandcommerceunderthestatecouncil.

article13inapplicationfortheregistrationofatrademark,aseparateapplicationshallbefiledinrespectofeachclassofgoodsorserviceaccordingtothepublishedclassificationofgoodsandservices.foreachapplicationforthetrademarkregistration,anapplicationfortrademarkregistrationshallbefiledwiththetrademarkoffice,accompaniedbyfivecopiesofthereproductionofthetrademark;ifcolourisclaimed,fivecopiesofthecolourreproductionofthetrademarkshallbeattached,soshallbeablackandwhitedesignofthetrademark.

thereproductionofthetrademarkmustbeclearandeasytopasteandshallbeprintedonsmoothandcleandurablepaperorsubstitutedbyaphotograph.itslengthorbreadthshallnotbemorethanl0cmandlessthan5cmeach.
